Grounds for Divorce in South Carolina

In South Carolina, divorce is governed by statute and must be based on grounds that are explicitly spelled out in the laws. Those grounds include:

  • Separation for a year or more, without cohabitation during that time period (this is South Carolina’s version of “no fault” divorce)
  • Adultery
  • Physical cruelty
  • Habitual drug or alcohol use/abuse
  • Desertion (lasting a year or more)

In addition, there are several other requirements that must be met before you may pursue a divorce in South Carolina courts. For instance, the state residency requirement prevents anyone who hasn’t lived in South Carolina for at least a year (or if both parties live in the state, both must have lived here for at least three months) from seeking a divorce here.

You should always consult a South Carolina domestic relations attorney before proceeding.
